This Privacy Policy explains how Born West Inc. ("Born West," "we," "us," or "our") collects, uses, and shares information when you visit bornwest.com (the "Site") or otherwise contact us through the Site. It applies to information collected through the Site only. Information handled under a signed client agreement (such as a Master Services Agreement, Statement of Work, or Data Processing Agreement) is governed by that agreement, not this policy.

For the purposes of the EU and UK General Data Protection Regulation ("GDPR"), Born West Inc. is the data controller for personal data collected through the Site.

Information we collect

Information you provide to us. When you fill out our contact form, schedule a call through our booking tool, apply through our careers page, or email us, we collect the information you choose to give us. This typically includes your name, email address, company, and the content of your message or inquiry. If you book a call, our scheduling provider also collects the date, time, and any details you enter.

Information collected automatically. When you visit the Site, we and our service providers automatically collect certain technical information, including your IP address, browser type, device information, pages viewed, referring URLs, and the dates and times of your visits. We collect this through cookies and similar technologies. See our Cookie Policy for details on the specific cookies in use and how to control them.

We do not intentionally collect special categories of personal data (such as health, biometric, or financial information) through the Site, and we ask that you not submit such information through our forms.

How we use information

We use the information we collect to:

  • respond to your inquiries and communicate with you;
  • schedule and manage calls and meetings you request;
  • evaluate and respond to job applications;
  • operate, maintain, secure, and improve the Site;
  • understand how visitors use the Site through aggregate analytics; and
  • comply with legal obligations and enforce our Terms of Service.

We do not sell your personal information, and we do not use it for cross-context behavioral advertising.

Legal bases for processing (EU/UK visitors)

If you are in the European Economic Area or the United Kingdom, we process your personal data on the following legal bases:

  • Consent — for non-essential cookies and analytics, where you have given consent.
  • Legitimate interests — to respond to your inquiries, secure and improve the Site, and understand aggregate usage, where those interests are not overridden by your rights.
  • Performance of a contract or pre-contractual steps — to respond to requests you make before entering into an engagement.
  • Legal obligation — where we are required to retain or disclose information by law.

You may withdraw consent at any time without affecting processing that already took place.

Cookies and analytics

The Site uses cookies and similar technologies, including Google Analytics (GA4) for aggregate usage measurement, and cookies set by embedded third-party services (our video player and our scheduling tool). How we share information

We share information only as described below. We do not sell personal information.

  • Service providers. We use third parties to host and operate the Site and its features, including our website host, analytics provider, video host, and scheduling provider. These providers process information on our behalf or as independent controllers under their own policies:
    • Website hosting and forms — Webflow
    • Analytics — Google Analytics (Google LLC)
    • Video embeds — Vimeo
    • Call scheduling — Cal.com
  • Legal and safety. We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Born West, our users, or others.
  • Business transfers. If Born West is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your personal information.

International transfers

Born West is based in the United States, and information collected through the Site is processed in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required, transfers of personal data from the EEA or UK rely on appropriate safeguards such as Standard Contractual Clauses.

Data retention

We retain personal information only as long as necessary for the purposes described in this policy, to comply with our legal obligations, resolve disputes, and enforce our agreements. Contact and inquiry information is retained for as long as needed to respond and for a reasonable period thereafter. Analytics data is retained according to our analytics provider's settings (by default, up to 14 months in aggregate form).

Your rights

EU/UK residents. Subject to applicable law, you have the right to access, correct, delete, or restrict processing of your personal data; to object to processing; to data portability; and to withdraw consent. You also have the right to lodge a complaint with your local data protection authority.

California residents. California's "Shine the Light" law allows California residents to request information about disclosures of personal information to third parties for direct marketing purposes; we do not share personal information for third-party direct marketing. Under the California Consumer Privacy Act, where applicable, California residents may have rights to know, delete, and correct personal information and to opt out of its sale or sharing; as noted above, we do not sell or share personal information.

To exercise any right, email privacy@bornwest.com. We will respond as required by applicable law and may need to verify your identity before acting on a request.

Do Not Track

Some browsers offer a "Do Not Track" ("DNT") signal. There is no common industry standard for how to respond to DNT signals, and the Site does not currently respond to them. You can control cookies and analytics as described in our Cookie Policy.

Children's privacy

The Site is intended for businesses and professionals and is not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, contact us and we will delete it.

Third-party links

The Site may link to third-party websites and services that we do not control. This policy does not apply to those sites, and we are not responsible for their privacy practices. Review their privacy policies before providing information.

Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be indicated on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the updated policy.
